1. Personal Information
The 311 App allows you to report a service request to the City and provides you the option to submit related photographs taken using your mobile device as well as your geographic location. For certain service requests, you must provide your name and contact information so the City can appropriately respond to your request. For other service requests, providing this information is optional.
All personal information requested or required is collected under the authority of section 33(c) of the Freedom of Information and Protection of Privacy Act (Alberta) (FOIP Act) for the purpose of responding to your service request and enforcing municipal bylaws. This information will be collected, used and disclosed in accordance with the FOIP Act. In particular, personal information submitted through the 311 App will be disclosed to appropriate business areas within the City so they may respond to your service request. For parking complaints, your information is provided to the City's parking enforcement contractor. In addition, if the service request leads to bylaw enforcement, your personal information may be required to be disclosed as part of the court proceeding. If this service request relates to a matter that involves an entity other than the City, such as utility service requests, your personal information may be disclosed to the appropriate entity in order to respond to the request. 2. Device information
By installing and using the 311 App, you agree that the City may collect and use information about your mobile device, including but not limited to your mobile telephone number. The City may collect and use this information for the purpose of contacting you about service requests submitted through the 311 App or providing you with general information about the 311 App and/or related City programs. 3. Copyright and Intellectual Property Rights
The 311 App and all of its contents are protected by Canadian and International copyright and trademark laws and may not be used or reproduced without the express written consent of the City. Unauthorized use of the 311 App or its contents may violate copyright, trademark and other laws. Copying, repackaging, redistributing or modifying the 311 App, in whole or in part, in printed or electronic format, is strictly prohibited.
The City grants you a limited, non-exclusive, non-transferable licence to access and make personal use of the 311 App for the non-commercial purpose of submitting and reviewing service requests. You are prohibited from modifying the 311 App or its contents in any manner whatsoever.
No derivative use of the 311 App or its contents or any use of data mining, robots, spiders, search/retrieval applications or similar data-gathering and extraction tools is permitted. Any unauthorized use of the 311 App automatically terminates the license granted by this Agreement.
If you submit a service request, including any photographs and your geographic location, you hereby grant the City an irrevocable, non-exclusive, royalty-free right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such submissions worldwide and you irrevocably waive all moral rights to such submissions. You represent and warrant that you own or otherwise control all rights to any submissions made and that your submissions do not violate this Agreement. You understand that the City does not guarantee any confidentiality with respect to any information submitted using the 311 App. In addition, you agree that you are not entitled to any compensation or reimbursement of any kind from the City for your submissions under any circumstances.
4. User Conduct
If you use the 311 App to submit a service request, photograph, or other information that the City, in its sole discretion, deems to be untrue, inaccurate, offensive, defamatory, threatening, obscene, not current, incomplete, or generally of a nature that does not pertain to the designated topic or theme or does not comply with this Agreement, or the City has reasonable grounds to suspect that such information is untrue, inaccurate, offensive, defamatory, threatening, obscene, not current, incomplete or generally of a nature that does not pertain to the designated topic or theme or does not comply with this Agreement, the City has the right to suspend or terminate your account and any service requests you may have submitted, and may refuse you current or future use of the 311 App (or any portion thereof) and immediately terminate this Agreement without notice to you.
You agree and acknowledge that the City has no obligation to pre-screen service requests submitted using the 311 App, and that the displaying of a service request, including any related photographs or geographic locations, in the 311 App does not imply, state, or represent that the City has confirmed or accepts the validity of the service request. The City retains the option, at all times and at its sole discretion, to refuse or remove any information submitted or displayed in the 311 App, including but not limited to any photographs, information, or content that violates this agreement or is deemed offensive, objectionable, or inappropriate.
5. Links
If the City provides any links or other direction to third party content or websites through the 311 App, you agree that such content is provided solely as a convenience to you. Third party content or websites are independently developed by parties other than the City and the City assumes no responsibility for the accuracy or appropriateness of the information contained in such content or websites. The inclusion of any link to another website or any other external content does not imply an endorsement by the City and should not be construed as an endorsement of that party or its product or services. If you decide to access such external links or websites, you do so entirely at your own risk.
